The law firm EQUITY successfully represented Bilanivskyy Mining and Processing Plant in Komsomolsk City Court in Poltava region in a dispute with Kremenchug District Council. The subject matter of the trial was the decision of the local district administration, which in fact prohibited development of Bilanivskyy ferruginous quartzite deposits.

The dispute followed the events in June 2013, when Kremenchug District Council approved the planning scheme for Kremenchug district, which provided for construction of a new mining and processing plant. However, in February 2014 the new management of the district council decided to impose a moratorium on the plan in terms of construction of Bilanivskyy Mining and Processing Plant. In July 2014 the company appealed to the court for invalidation of such decisions of the local government. The trial lasted for more than six month sand as a result the court ruled a decision that granted the claim of the company.

“The Resolution of Komsomolsk City Court in Poltava Region is important for each participant of social relations as it tames the arbitrariness of the authorities (in particular, Kremenchug district council) in the implementation of their power. The legal position of the court creates good practice to protect the violated rights and interests of people in public legal relations, contributes to the stability of social relations and improve the investment climate in Ukraine”- said EQUITY partner Vyacheslav Krahlevych who represents Bilanivskyy Mining and Processing Plant in the courts.
